These Terms & Conditions apply when you purchase or participate in a class or programme through Brave Art Academy.

2. Our classes

Most Brave Art Academy classes are online, self-paced classes.

For established classes, all lessons are normally available immediately after purchase, and you are free to work through them in whichever order and at whichever pace suits you.

New classes may initially be released gradually. This is sometimes called “dripping” lessons. Once all scheduled lessons have been released, the class remains available as a normal self-paced class.

Some longer programmes may also include scheduled live sessions using Zoom or another external online meeting platform.

The exact content, format and any scheduled elements of a class will be described on the relevant class page.

3. Lifetime access

Classes sold with lifetime access do not have an expiry date and are intended to remain available to you for your lifetime.

Naturally, continued online access depends on Brave Art Academy continuing to operate and retaining the legal and technical ability to provide the relevant material.

If Brave Art Academy ever permanently ceases operating, we will make reasonable efforts to notify students well in advance. Where course videos and other materials are available for download, we will provide students with a reasonable opportunity to download those materials for their personal use before the academy closes.

Occasional maintenance, technical problems or changes to our website, hosting or video platforms do not constitute termination of lifetime access.

4. Live sessions and recordings

Some classes and programmes include live online sessions, usually held using Zoom.

These sessions may be recorded so that students who cannot attend live can watch them later. Recordings may subsequently be made available inside the relevant class, for example using Vimeo.

Students who participate in a live session may therefore appear or be heard in the recording. We will make it clear when a session is being recorded.

If you prefer not to appear in a recording, you can keep your camera switched off and avoid speaking while the recording is taking place, where this is compatible with the session.

Recordings placed inside a class are intended for students enrolled in that class and are not intended for unrestricted public distribution.

5. Purchases and payment

The prices shown on our website include VAT where applicable. Customers outside the European Union are generally not charged EU VAT. The price shown at checkout is the amount you will be charged.

Payment methods available to you are displayed at checkout and may include payment methods processed through Stripe and PayPal.

Your place in, or access to, a class is normally provided after successful payment.

If a payment fails, is reversed, refunded or disputed, we may temporarily suspend the associated class access while the matter is resolved.

6. Student accounts

Your Brave Art Academy account is personal to you.

Please keep your login details secure and do not share your account with other people.

One purchase gives access to the person for whom the class was purchased unless the class description specifically says otherwise.

If you believe somebody has gained unauthorised access to your account, please contact us.

7. Teenagers and younger students

Teenagers are welcome to participate in Brave Art Academy classes.

If you are under 18, or are not legally able to enter into the purchase agreement yourself under the law that applies to you, the purchase should be made by, or with the permission of, a parent or legal guardian.

Parents and guardians remain responsible for deciding whether a particular class or online activity is appropriate for the young person participating.

8. Downloadable videos and materials

Many of our classes allow students to download videos, PDFs, reference material, photographs or other course resources.

These downloads are provided for your personal use only.

You may keep and use downloadable course materials for your own learning, but you may not redistribute, upload, publish, sell, sublicense or provide copies of the course materials or videos to other people.

The fact that course material itself is protected does not prevent you from creating your own original artwork using techniques or ideas that you have learned in a class, or from selling your own original artwork.

Not every class or every item of course content is necessarily downloadable. This may depend on technical limitations, copyright, licensing agreements or arrangements with individual instructors.

9. Copyright and intellectual property

The videos, photographs, written lessons, downloadable resources, designs and other teaching materials made available through Brave Art Academy are protected by copyright and other intellectual-property rights.

Depending on the class, those rights may belong to Brave Art Academy, the individual instructor or another rights holder.

Purchasing a class gives you permission to use the teaching materials for your own personal learning. It does not transfer ownership of those materials or the copyright in them to you.

10. Carla Sonheim classes and geographic availability

Certain classes provided in cooperation with Carla Sonheim Presents are offered through Brave Art Academy only to customers located outside the United States and Canada.

Customers in the United States or Canada may therefore need to purchase those particular classes through the appropriate Carla Sonheim sales channel instead.

Any geographic restriction applicable to a particular class will take precedence over the general availability of other Brave Art Academy classes.

11. Changing or updating classes

Art classes naturally evolve. We may occasionally correct errors, update links, improve videos or written material, reorganise lessons, or replace obsolete technology.

We may also change the technical platforms used to deliver classes, provided that this does not unreasonably remove the class access you purchased.

For new or ongoing classes, release schedules or live-session dates may occasionally need to change. If an important scheduled element changes, we will make reasonable efforts to inform affected students.

12. If a class isn’t right for you

We want students to enjoy the classes they purchase.

If you feel that a class genuinely isn’t right for you, please contact us. We will try to find a fair and friendly solution. Depending on the circumstances, this may include moving you to another class or providing another appropriate solution.

This goodwill approach does not reduce any statutory consumer rights that you may have.

13. Right of withdrawal

Where consumer law gives you a statutory right to withdraw from an online purchase, that right continues to apply.

For consumers in the European Union, this will generally include a 14-day withdrawal period for distance contracts, subject to the applicable legal rules and exceptions.

Brave Art Academy does not currently require customers to waive that statutory withdrawal right in exchange for receiving immediate access to a class.

You do not need to give a reason when exercising a statutory withdrawal right.

You can contact us using the contact details above or use the online withdrawal function provided on our website.

Nothing in these Terms limits consumer rights that cannot legally be excluded or restricted.

14. Technical requirements and external services

You are responsible for having a suitable internet connection, device and web browser for accessing online classes.

We use external technology providers to help deliver our services. Depending on the class, these may include video-hosting and communication services such as Vimeo, Bunny.net and Zoom.

Those external services may occasionally experience interruptions outside our control. We will make reasonable efforts to restore access or provide an alternative where practical.

15. Community and respectful participation

Where a class includes discussions, live sessions or other opportunities for students to interact, we ask everyone to treat fellow students, instructors and staff respectfully.

We may remove content or restrict participation where reasonably necessary to deal with abusive, unlawful, threatening, discriminatory, deliberately disruptive or infringing behaviour.

16. Availability and liability

We take reasonable care in operating Brave Art Academy and maintaining access to purchased classes.

Internet services are not completely immune from temporary outages, maintenance, third-party service failures or circumstances beyond our reasonable control.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, and nothing affects the statutory rights available to consumers.

17. Privacy

Personal information is handled in accordance with our Privacy Statement and Cookie Policy.

Separate privacy information may apply when you use external services such as Zoom, Vimeo, payment providers or other third-party platforms.

18. Complaints and problems

If something has gone wrong, please contact us first.

We genuinely prefer to solve problems person-to-person and will make reasonable efforts to find a fair solution.

[contact email]

19. Changes to these Terms

We may update these Terms occasionally, for example when our services or applicable laws change.

Changes will not retrospectively remove rights attached to a purchase you have already made.

The version presented when you purchase a class will generally apply to that purchase.

20. Applicable law

These Terms are governed by Dutch law.

If you are a consumer living in another country, this choice of law does not remove mandatory consumer protections that apply to you under the laws of your country of residence.
